            <description><![CDATA[Amends the Liquor Control Act of 1934. Changes the short title of the Act to the Liquor and Hemp Products Control Act and makes conforming changes throughout the statutes. Establishes the Hemp Products Commission as a division of the Illinois Liquor Control Commission and establishes local hemp products control commissions. Provides that the Hemp Products Commission shall have the same authority conferred upon the State Commission under specified provisions with respect to alcoholic liquors but only with respect to hemp products. Provides that no hemp product may be given, sold, transferred, or delivered to any person under 21 years of age. Establishes hemp products grower or cultivator licenses, hemp products processor or manufacturer licenses, hemp products distributor or wholesaler licenses, and adult-use hemp products retailer licenses. Sets forth provisions concerning taxation of hemp cannabinoid products; licensing requirements and fees; powers and duties of the Hemp Products Commissions; powers and duties of local hemp products control commissioners; hearings and appeals; the production, processing, manufacturing, sale, and distribution of hemp products and adult-use hemp products; labeling, testing, and advertising requirements; recordkeeping and reporting; social equity; and applicability. Effective January 1, 2027.]]></description>

            <title><![CDATA[[IL] SB3919: REGULATING HEMP]]></title>
            <description><![CDATA[Amends the Cannabis Regulation and Tax Act. In the definition of "cannabis", provides that "cannabis" does not include hemp, industrial hemp, or Illinois hemp for human consumption as defined and authorized under the Industrial Hemp Act, but includes intoxicating hemp as defined under the Industrial Hemp Act. Amends the Industrial Hemp Act. Revises definitions to conform to federal law. Adds definitions of "Illinois hemp for human consumption", "intoxicating hemp", and "synthetic hemp product". Directs the Department of Agriculture to adopt rules to conform to federal law. Directs the Department to also adopt rules regarding hemp products intended for human consumption that (1) require testing, (2) establish labeling requirements, (3) require child-resistant packaging, and (4) prohibit branding attractive to children. Prohibits the sale, offer for sale, delivery, or furnishment of a hemp product intended for human consumption to a person who is under 21 years of age. Prohibits the manufacture, distribution, sale, offer for sale, delivery, or furnishment of synthetic hemp products. Provides for civil penalties for violations to be deposited into the Industrial Hemp Regulatory Fund. Provides that the exception in the Cannabis Control Act for the Industrial Hemp Act does not apply to synthetic hemp products. Amends the Cannabis Control Act. Changes the definition of "cannabis".]]></description>

Amends the Industrial Hemp Act to establish a comprehensive regulatory framework for hemp and hemp-derived cannabinoid products, including licensing, registration, packaging and labeling standards, age verification, laboratory testing, recordkeeping, enforcement, and penalties. Creates the Hemp Social Equity Fund to support loans, grants, and technical assistance for social equity applicants. Makes conforming changes to the State Finance Act.             <title><![CDATA[[IL] HB64: HEMP REGULATION REFORM]]></title>
            <description><![CDATA[Amends the Illinois Food, Drug and Cosmetic Act. Provides that, notwithstanding any other provision of law, a food, food ingredient, dietary supplement, cosmetic, or other consumer product shall not be considered adulterated solely because it contains hemp, hemp-derived cannabinoids, including, but not limited to, Delta-9 tetrahydrocannabinol (THC), Delta-8 THC, tetrahydrocannabinolic acid (THCa), or any hemp product, provided that the hemp used in the product complies with the definition of "hemp" as specified in federal law. Amends the Industrial Hemp Act. Conforms several provisions in the Act to federal regulations under the Domestic Hemp Production Program, including (i) definitions, (ii) requirements for the application for a license to cultivate hemp, and (iii) rulemaking requirements for the Department of Agriculture. Provides that the Department of Agriculture shall adopt rules for the distribution and retail sale of hemp products under conditions in specified provisions of the Act. Provides that hemp products that contain cannabinoids, that are intended for human consumption, and that are designated for retail sale within Illinois (i) must meet specified requirements, including federal requirements and rules adopted by the Department of Public Health, and (ii) must be distributed or sold in a container that includes specified information. Provides that hemp products that are intended for inhalation or ingestion and contain detectable amounts of hemp cannabinoids may not be sold in this State to a person who is under 21 years of age. Provides that hemp products distributed or sold in violation of specified provisions in the Act shall be considered adulterated or misbranded pursuant to the Illinois Food, Drug and Cosmetic Act and all other applicable State laws. Defines terms. Makes technical changes.]]></description>
